Understanding Maryland’s Wrongful Death Statute
In Maryland, a “wrongful death” is classified as the death of a person due to neglect, default, or a wrongful act, including illegal conduct. If the person who passed away would have had grounds for a personal injury lawsuit had they lived, their death is classified as “wrongful” under state law.
Many different types of accidents can give rise to a wrongful death lawsuit, including but not limited to:
- Bicycle accidents
- Birth injuries
- Car accidents
- Defective product accidents
- Medical malpractice
- Motorcycle accidents
- Nursing home abuse and neglect
- Slips, trips, and falls
- Truck accidents
- Unsafe property conditions
- Work accidents
Additionally, illegal acts that lead to fatalities—such as manslaughter and homicide—can result in grounds for a wrongful death claim. In such cases, the wrongful death lawsuit would be separate from any criminal proceedings that occur.
Who Can File a Wrongful Death Claim?
State laws specify who is allowed to file a wrongful death lawsuit in Maryland. First, the deceased’s spouse, children, and/or parents are permitted to file a claim; if no such person exists, anyone who is related to the deceased, whether through blood or marriage, and who was dependent upon the deceased prior to their death may file a claim.
